Marking products with the CE mark is a prerequisite for the admission of products to the market of the European Union. The CE mark (from the French Conformité Européenne - European conformity) has been used in the European Union since 1985
By affixing the CE marking to a product, the manufacturer, importer or seller in the European market guarantees that the product complies with all directives and regulations applicable in the EU for this type of product and is safe for the consumer and the environment.
PROCEDURE FOR CONFIRMING COMPLIANCE WITH THE REQUIREMENTS OF THE EU DIRECTIVES
1. Determine the list of EU Directives applicable to products. Identify applicable standards.
As an example, a television is subject to EU directives/regulations that require:
• A) electrical fire safety (LVD)
• B) electromagnetic compatibility (EMC)
• B) content of hazardous substances (RoHS)
• D) recycling (WEEE)
• E) Energy efficiency and energy labeling
• E) Radio communications (RED)
2. Determine the form of product conformity assessment (in accordance with EU Regulations and applicable EU directives/regulations).
3. Carry out product testing and inspection of the production site (depending on the selected conformity assessment module). In this case, it is necessary to take into account the national requirements of individual EU member states (if any)
4. Prepare a complete package of technical documentation confirming compliance with the technical requirements of all applicable EU Directives
5. Draw up an EC Declaration of Conformity listing all applicable Directives
6. Apply the CE marking to products
CE MARKING REGULATIONS
Only the manufacturer or his authorized representative in the EU (if the manufacturer is not a resident of the EU) has the right to apply the CE mark on products. By affixing the CE mark to a product, the manufacturer assumes responsibility for its compliance with the applicable EU directives. The CE mark can only be affixed to products that comply with all applicable EU directives and regulations.
Each product sample must be labelled. The marking sign must be clear, easy to read and indelible, its minimum size is 5 mm, while maintaining the proportions of the sign. If it is impossible to put a mark on the product, it is applied to the accompanying documentation and packaging.
Separate EU directives also lay down additional marking rules, such as the explosion protection mark EX with explosion protection group, class and application area for explosion-proof equipment or special metrological marking in the form of the letter "M" for measuring instruments
LIABILITY FOR VIOLATION OF EU LEGISLATIO
Manufacturers, importers and end sellers are responsible for the conformity of products with the requirements of EU directives and the correct CE marking.
Monitoring compliance with the labeling rules is carried out by the national supervisory authorities of the EU Member States. Each state itself provides for a measure of responsibility, if it is proportional to the violation. In case of gross violations, criminal liability is provided, among other things.
